The agreement between you and Smartious E-School Ltd when you use our website, portals, and services.
These Terms of Service ("Terms") govern your use of smartioushomeschool.com and any educational services provided by Smartious E-School Ltd ("Smartious"). By enrolling a student, creating an account, or using any part of our website or services, you agree to these Terms. If you do not agree, please do not use our services.
To enrol a student, you must be the student's parent or legal guardian and at least 18 years old. Students under 18 cannot create an account without parental consent. We reserve the right to verify identity at any stage, particularly before releasing academic records or issuing predicted grades.
Enrolment begins when you submit the enrolment form and pay the USD 38 (KSh 5,000) application fee. The assessment fee is non-refundable once the placement test has been served, but counts towards your first month of tuition if you proceed to enrol. We aim to match a tutor within 48 working hours of a completed assessment.
All fees are stated in US Dollars. Local currency equivalents (e.g. KES for Kenyan families) are shown for convenience but the dollar price is the contractual amount. Fees are payable in advance , monthly, termly, or annually as selected. Termly payments attract a 5% discount; annual payments attract a 12% discount. Payments are processed via Paystack. We accept M-Pesa, Visa, Mastercard, bank transfer, and Apple Pay.
You may cancel your enrolment with 30 days' written notice. Within the first 14 days of enrolment, you may cancel for any reason and receive a full refund of any unused tuition. After 14 days, refunds are prorated to the next billing period minus any assessment or setup fees already delivered. Termly and annual payments are refunded for the unused balance only. The USD 38 / KSh 5,000 application fee is not refundable once the assessment has been served.
You agree to: (i) provide accurate information when enrolling; (ii) ensure your child attends scheduled lessons or gives reasonable notice for cancellations; (iii) provide a safe, supervised environment for home-visit tuition in Nairobi; (iv) treat Smartious staff, tutors, and our digital platforms with respect; (v) not share your portal login credentials with anyone outside your household; (vi) not record, reproduce, or redistribute our teaching materials or live lessons without written permission.
Smartious will: (i) deliver lessons, materials, and assessments as described in your enrolment package; (ii) provide qualified, background-checked tutors; (iii) keep academic records for at least 7 years; (iv) issue progress reports as specified in your plan; (v) communicate any material changes at least 30 days in advance; (vi) act in the student's best academic interests at all times.
All content published by Smartious , teaching materials, lesson recordings, assessment banks, software, the Mshauri AI tutor, and the website itself , is the intellectual property of Smartious E-School Ltd or our licensors. You may use this content only within your own household for the enrolled student's education. Commercial use, redistribution, or resale is strictly prohibited and may result in termination of services and legal action. Past papers and marking schemes are the property of their respective exam boards (Cambridge, Edexcel, IB) and are reproduced under licence or fair-dealing provisions.
We strive to match each student to the same dedicated tutor for the duration of enrolment. Where a tutor becomes unavailable (illness, relocation, resignation), we will provide a qualified substitute and notify you as soon as reasonably possible. No refunds are issued for minor, temporary substitutions; extended changes may entitle you to a prorated refund or free rematching.
We reserve the right to suspend or terminate services , without refund , if a parent or student engages in abusive, discriminatory, or harassing behaviour towards our staff or tutors; attempts to defraud or deceive Smartious; or repeatedly breaches these Terms after written warning. This is rare, but necessary to protect our team.
To the maximum extent permitted by Kenyan law, Smartious is not liable for: (i) exam results or university admissions: our role is to teach and prepare; outcomes depend on many factors including the student's effort and the decisions of exam boards and universities; (ii) indirect, consequential, or punitive damages; (iii) delays or outages caused by third-party services (Paystack, Google, Netlify). Our total liability for any claim is limited to the fees you have paid us in the 12 months preceding the claim.
These Terms are governed by the laws of Kenya. Any dispute arising from these Terms or our services will be resolved first by good-faith negotiation, then by mediation in Nairobi under the Mediation (Court-Annexed) Rules, and only then by the courts of Kenya, which have exclusive jurisdiction.
We may update these Terms from time to time. Material changes will be communicated to active students and parents at least 30 days in advance by email. Minor clarifications (typos, reformatting) may be made without notice. The current version is always published here with its effective date.
