Homeschool laws & regulatory framework in the Czech Republic
The Czech framework is one of the most precisely defined in Europe — and it contains the earliest end-of-obligation of any country we serve. Here is exactly how it works, including the parts most providers skip.
Individualni vzdelavani is explicit in the Education Act
Section 41 of the Education Act (zakon c. 561/2004 Sb.) provides for individual education — what families call domaci vzdelavani — as a recognised way of fulfilling compulsory school attendance. Since 1 September 2016 it covers the full basic-school span, grades 1-9. The director of the school where the child is enrolled decides on the parents' written application, which must set out the reasons, the conditions (materials, health protection, textbooks), proof of the educator's qualification, and an opinion from a school counselling facility (a pedagogical-psychological counselling centre or special-education centre).
The tiered qualification rule
The person educating the child must hold at least secondary education completed with the maturita for a pupil at the first stage (grades 1-5), and higher (university) education for a pupil at the second stage (grades 6-9). Families should know this before assuming the Czech route matches Poland's post-2021 lightness — the Czech application is genuinely assessed, the counselling opinion is still required, and the director can terminate the arrangement if conditions lapse or the pupil fails.
Half-yearly exams — the heaviest frequency, the shortest span
An individually educated pupil sits examinations in the relevant curriculum for each half-year (pololeti), at the school of enrolment — typically January and June. In practice, the homeschool-experienced schools run these as portfolio reviews, presentations, or discussions rather than formal written papers, and a national network of such schools (with coordinators and online consultations; the Asociace domaciho vzdelavani helps families choose) makes the mechanism routine. Compared with the countries we serve in equal depth: Poland examines annually to 18, Italy annually to 16, Portugal at cycle ends only — and the Czech Republic examines twice yearly but stops earliest of all.
The obligation ends at 15 — the earliest in our coverage
Povinna skolni dochazka — compulsory school attendance — lasts nine school years, ending with grade 9 at around age 15. After that there is no obligation to attend school and no s.41 framework to comply with: upper-secondary education is voluntary in law. Read against the Cambridge pathway, this is decisive: part of the IGCSE years and the entirety of the A-Level years fall after the Czech obligation ends, with no Czech exams, no Czech enrolment, and no permissions of any kind. Italy's equivalent moment arrives at 16; the Czech Republic's at 15. Almost no provider states this, and it should shape every plan for a student aged 13 or older.

For students in grades 1-9, the Czech school of enrolment covers the half-yearly prezkouseni — portfolio-based at the experienced schools — while Smartious delivers the live Cambridge, IB, or American track alongside, with both calendars planned together. From grade 9's end, the Czech track simply falls away and the international programme continues alone into IGCSE completion and A-Levels. Families with children aged 13-15 should plan the transition deliberately: it is the point where the Czech system's requirements end and the international qualification becomes the whole story.
