Homeschool laws & regulatory framework in the Luxembourg
Luxembourg asks for authorisation, not notification — and it is rewriting the rules as we speak. Here is the framework exactly as it stands, including the parts that make us position ourselves as a supplement rather than a substitute.
The obligation: ages four to sixteen, twelve consecutive years
Every child resident in Luxembourg, national or foreign, is subject to the obligation scolaire from the age of four until sixteen, across a minimum of twelve consecutive years. It can be satisfied in the public system, in a private school, in a European school, or abroad — and, under conditions set by law, at home. An extension of the obligation to eighteen has been under political discussion since 2022; its current status should be confirmed with the Ministry rather than assumed, and we do not market a post-16 window in Luxembourg.
The 2023 law: authorisation, and control of what is learned
The law of 20 July 2023 on the obligation scolaire changed the position materially. It introduced a requirement of prior authorisation from the Ministry of Education for home education — extending that requirement to secondary level, where the position had previously been freer — placed responsibility for controlling compliance with the obligation scolaire on the Minister, and provided for reinforced control of the knowledge and competences a home-taught minor actually acquires. Luxembourg is therefore an authorisation country in the same family as Hungary and Austria, and it should never be described as a notification market.
The reform in progress — and why it matters to international families
A further bill has been working through the legislative process since 2025 to build one coherent home-education framework across fundamental and secondary education. Its most consequential feature for our families is the way it frames what may be taught at home: school programmes organised by Luxembourg public establishments, by establishments under the European Schools Convention, or by private establishments approved by the Luxembourg State — explicitly opening home education to the country's full public and private school offer, and presented in the bill's own materials as an asset for international families settling here. The bill also restricts in-person home teaching to children of a single household, to prevent unlicensed group schools forming.
What that means for an overseas online school — stated plainly
It means an overseas online curriculum is not automatically an authorised programme for satisfying the Luxembourg obligation scolaire, and we will not pretend otherwise. Our clean default here is supplementary: the family's school enrolment — public, private, European, or international — carries the legal obligation, while Smartious teaches the Cambridge or IB track live alongside it, building toward external examinations. Families who want a full home-education arrangement should take that conversation to the MENJE directly, and because the framework is mid-reform, current requirements should be confirmed there rather than read from any provider's website, including ours.
How rare this is, and why that matters
Context is worth having: on ministry figures, home education in Luxembourg involves a few hundred children across the whole country — well over a hundred at fundamental level and a few dozen at secondary. Officials are not processing these applications weekly, the reasons recorded are typically illness, families passing through the country, or parental conviction, and a well-documented application therefore stands out for the right reasons. That is exactly what a structured live school produces as a by-product: timetables, schemes of work, assessment records, and external examination results.

Luxembourg families are among the most internationally mobile in Europe at university stage, and Cambridge A-Levels and the IB Diploma are read fluently by precisely the systems they use: UK universities via UCAS, Belgian, French, German, and Dutch universities directly, and the University of Luxembourg itself — young, multilingual, teaching in English, French, and German — which admits international qualifications with requirements confirmed per programme.
