Homeschool laws & regulatory framework in the Netherlands
The Netherlands has no home-education right — and the one narrow exemption is in active legal flux as of 2026. Here is the whole picture stated exactly, followed by what a serious online school can lawfully do here.
Leerplicht: enrolment, not just education
Dutch children are leerplichtig from age five through the school year in which they turn sixteen, and the duty is met by enrolment at (and attendance of) a recognised school. Kwalificatieplicht then continues to eighteen until a startkwalificatie — a havo, vwo, or mbo-level-2 diploma — is achieved. Home education does not exist as a recognised form in the Leerplichtwet, and enrolment with an unrecognised foreign or online school does not satisfy either duty. That is the starting point of every honest conversation about online schooling in the Netherlands.
Article 5 onder b: the narrow exemption, stated exactly
The Leerplichtwet exempts parents from the duty to enrol where they hold overriding objections (overwegende bedenkingen) to the direction — the religious or philosophical richting — of every school within reasonable distance of their home, notified to the municipality under Articles 6 and 8. Its use has grown from 575 children in 2013-14 to roughly 2,860 in 2024-25, currently without inspection of the education those children receive. Two constraints define it: the objection must concern richting rather than pedagogy or quality, and the exemption is essentially unavailable once a child has been enrolled at a school of that direction.
The 2026 flux: a tightened framework and resuming enforcement
The legal ground moved in 2025-26. The public prosecution service suspended enforcement of refused 5b cases in April 2025, citing insufficient legal clarity; the Hoge Raad then ruled on 21 April 2026, clarifying and tightening the framework — notably that objections against public (openbaar) education can succeed only in exceptional cases — and the OM has announced it will resume criminal enforcement on that basis. A legislative proposal would additionally require exempted families to submit a home-education plan under quality supervision. The direction of travel is unmistakable, and any family considering this route needs a Dutch education lawyer, not a school's marketing page.
