Spain's position on home education is genuinely different from every other country Smartious serves, and we think families deserve a straight answer rather than reassuring language that overstates what we can guarantee.
Homeschooling is a legal grey area — not a regulated pathway
The Spanish Constitution (Article 27) guarantees the right to education, and the Organic Law of Education (LOE/LOMLOE) requires children aged 6 to 16 to receive compulsory education. Neither law specifies that this must happen inside a school building, but neither mentions, regulates, or authorises home education either. This silence is the grey area. Estimates suggest 2,000–4,000 families homeschool in Spain. Some are never questioned; others have faced scrutiny or legal proceedings. Outcomes vary by autonomous community — Catalonia has the most established homeschool community and is generally regarded as the most tolerant in practice; other regions vary. Visa-linked school enrolment — the sharpest practical risk for expat families
Spain's Non-Lucrative Visa and Digital Nomad Visa both commonly require proof of school enrolment for dependent children as part of the application or renewal process — the exact requirement varies by consulate and visa type. What Smartious is, and isn't, in this context
Smartious is an accredited international curriculum provider — students enrol formally, receive report cards and transcripts, and sit recognised Cambridge, Pearson Edexcel, or American examinations.
